TERMS AND CONDITIONS
These terms and conditions serve as the contract between the customer and Armida’s Mini Pie Company & Bakery. Terms and conditions are subject to change without notice.
PAYMENTS
--All sales are final.
--All payments are non-refundable within 7 days of Pick Up/Delivery date. Any cancellations within that time will be given as bakery credit, not including any deposits paid. See Cancellations below for further details.
--30% non-refundable deposit will be required on all orders over $75.
--The non-refundable deposit gives your order priority within 3 days of event. When I take your deposit, I begin the process of declining other orders within your date range.
--The balance must be received within the following time frames below. Non-refundable deposits should be received at time of order confirmation or 1 week after first tasting consultation. Final payments are due on pick up/delivery date. A 10% late fee or $8 will be charged if the final payment is late.
CAKE & CUPCAKE ORDERS (except Weddings or Large Events)
--Must be ordered 7 days or more in advance. Some exceptions may be made. Please contact Armida for payment requirements and more information.
--A 30% non­-refundable deposit is required on all cake orders over $75.
--Final payment is due at time of delivery or pickup.
--If this order has been approved and placed within 7 days of the event date, payment in full is required at time of order confirmation.
--A 10% late fee or $8, whichever is greater, will be charged if the final payment is late.
WEDDING & LARGE EVENT ORDERS
--Must be ordered 60 days or more in advance. Some exceptions may be made, contact Armida for inquiries.
--Changes to flavors or design elements within 12 days of event will incur a $100 fee when change is made.
--A 30% non­-refundable deposit is required on all orders and will be due within 1 week of tasting & design consultation.
--Tasting & design consult included with order must be completed 4 or more weeks prior to event, unless other arrangements have been made.
--Final payment is due on or before delivery or pickup.
--If this order has been approved and placed within 30 days of the event date, payment in full is required within 1 week after tasting & design consultation.
--A 10% late fee or $8, whichever is greater, will be charged if the final payment is late.
ORDER CHANGES (EXCEPT WEDDING OR LARGE EVENTS)
--The final date of any changes for the size, flavor, style, etc. of an order are due 7 days prior to the event. Any changes after this date cannot be guaranteed and may be subject to additional charges.
--All changes to existing orders must be submitted in writing through email only. Changes communicated via phone, social media messaging, text, etc. will not be honored.
VARIATIONS IN DESIGN
-- While Armida’s Mini Pie Company & Bakery makes every effort to provide exactly the flavor, filling, decoration, size, color, shape, and design discussed during consultations, creating baked goods is an art form and may be subject to variations.
-- If the customer supplies an image or likeness to be created, Armida’s Mini Pie Company & Bakery will make every attempt to make the item as close to the likeness as possible. In the event that the product requires equipment or ingredients that cannot be obtained within the time allotted (molds, shapes, any additional novelty such as glitter), changes will be discussed during final consultation.
RETURNS & REFUNDS
--If products are not provided in a satisfactory manner as notated on this order form, return of entire order and a full refund will be given at time of pick up or delivery only.
-- All grievances concerning products provided must be submitted in writing via email within seven (7) days of the date of pick up or delivery. Any compensation provided in response to a grievance will be in the form of bakery credit only.
-- All food sales are final.
-- The Parties will attempt in good faith to resolve any dispute or claim arising out of or in relation to this Agreement through negotiations between Armida’s Mini Pie Company & Bakery and the client to settle the relevant dispute.
CANCELLATIONS
--Any cancellations must be made in writing via email only.
--Cancellations between 14 – 7 days prior will receive refund in form of original payment not including any deposit, if paid.
--Cancellations within 7 days of pick up or delivery will result in a bakery credit of non-deposit payment amounts ONLY.​
RIGHTS & WAIVERS
-- Armida’s Mini Pie Company & Bakery reserves the right to take photos of your product for social media and/or marketing materials prior to pick up or delivery. Pictures will not be publicized until after customer has received their order.
-- Armida’s Mini Pie Company & Bakery is not responsible for any damage to the order after delivery or pick up.
-- If the customer elects to pick up the order, the customer is responsible for the order as soon as it in their possession. Upon visual inspection of the order and its departure from Armida’s Mini Pie Company & Bakery, the customer approves the order’s visual appearance and waives any rights to a refund based on the style, design or visual appearance of the order.
-- The product may contain or come into contact with milk, wheat, nuts, soy and other allergens. The customer is responsible for notifying anyone consuming their purchased baked goods. Armida’s Mini Pie Company & Bakery is not responsible for any adverse effects of allergic reactions.
-- Upon the event of a natural disaster, accident or other situation outside of Armida’s Mini Pie Company & Bakery's control, this contract may be voided.
-- Armida’s Mini Pie Company & Bakery will make every effort to provide a positive client experience and baked goods. Armida’s Mini Pie Company & Bakery’s total liability is hereby limited to amounts paid to Armida’s Mini Pie Company & Bakery for its goods. Armida’s Mini Pie Company & Bakery will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of whether liability is based on breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise.
-- Only items, actions and baked goods details explicitly listed on the order form are guaranteed by Armida’s Mini Pie Company & Bakery.
